PAYMENT TERMS

💸 These “Payment Terms” apply whenever you purchase any paid or premium service (“Paid Service”) from CARING TECHNOLOGY FOR KNOWLEDGE INC. (hereinafter, the “Company,” “we,” or “us”). Please read these Payment Terms carefully to understand your rights and obligations, as they constitute a legally binding agreement between you and the Company with respect to the purchase and use of our Paid Services.

By purchasing or using any Paid Service, you acknowledge that you have read, understood, and agree to be bound by these Payment Terms. We reserve the right to modify these Payment Terms at any time without notice due to changes in our services or in applicable laws. The Payment Terms in effect at the time you confirm a transaction will govern that transaction.

1. Payment of Fees; Taxes

1.1. Fees for Paid Services

  • When you purchase a Paid Service, you agree to pay all fees in the currency specified by us at the time of purchase. You accept any currency fluctuation risks (if applicable).

  • The listed fee for any Paid Service may or may not include taxes (e.g., VAT, sales tax). If any tax or fee required by your local laws is not collected by us, you remain solely responsible for reporting and paying such tax or fee to the relevant authority.

1.2. Third-Party Charges

  • The fees for our Paid Services do not include third-party costs you may incur, such as mobile data charges, ISP fees, card transaction fees, or any fees associated with other third-party services or applications that you may use in conjunction with our Paid Service.

  • You are solely responsible for selecting, managing, and paying for all such third-party costs.

2. Autorenewal

2.1. Payment Methods

  • We accept credit cards, debit cards, PayPal (or similar methods) for payment of Paid Services (“Accepted Payment Method”). Your initial billing date corresponds to the date you purchase the Paid Service.

2.2. Recurring Renewals

  • If you purchase a Paid Service on a recurring basis (monthly, quarterly, annually, etc.), you agree that we will automatically charge your Accepted Payment Method at the start of each subsequent billing period.

  • The billing date typically coincides with (or is close to) the day you initially subscribed. If a given month does not contain the same date as your initial purchase date (e.g., you purchased on January 30, but February ends on the 28th or 29th), we will process your payment on the last day of that month.

2.3. Payment Method Responsibilities

  • You must ensure your payment information (e.g., card details, PayPal account) is accurate and updated (such as upon card expiration).

  • If the payment on your Accepted Payment Method is declined, we reserve the right to suspend or terminate your Paid Service unless you promptly resolve the payment issue.

3. Changes in Fees

3.1. Right to Modify Fees

  • We may, at our discretion, adjust the fees for Paid Services (e.g., increasing, decreasing, or introducing new fees) in response to business or legal requirements.

  • Such changes will generally take effect in the next billing cycle after your current subscription term ends, unless otherwise stated in our notice to you.

3.2. Option to Not Renew

  • If you do not agree to the new fees, you may opt not to renew the Paid Service before the revised fees take effect.

  • Your continued use of the Paid Service following the effective date of any fee change constitutes your acceptance of the new fee structure.

4. Cancellation of a Service

4.1. Your Right to Cancel

  • You may cancel your Paid Service at any time. Cancellation takes effect at the end of the current billing period.

  • Even if you cancel mid-cycle, the Paid Service remains active until the end of the billing period you have already paid for, unless otherwise specified. No refunds will be provided for any unused portion of a billing cycle (unless explicitly stated by us).

4.2. Cancellation Process

  • To cancel, please email us at support@familymate.ai with your account details (e.g., email/username) and the request to cancel a specific Paid Service.

  • We will process your cancellation within five (5) business days upon receiving your request.

4.3. Refunds

  • If you decide not to continue using a Paid Service and wish to request a refund, you must contact us within seven (7) days of the purchase or receipt of the Paid Service. After that period, we consider you to have accepted the Paid Service.

  • We may refund the prorated portion of any prepaid fees applicable to the period after the effective cancellation date, subject to our verification. If approved, refunds are generally processed within five (5) business days.

5. Failure to Pay

5.1. Non-Payment by You

  • If you fail to pay any amount owed for a Paid Service on time, we may:

    • Immediately terminate your Paid Service, or

    • Suspend it for a limited period. During suspension, you remain responsible for the due fees.

  • You are responsible for ensuring that your payment method information remains current and valid.

5.2. Notifications

  • We may, but are not obligated to, send you a reminder or notice if a payment is declined. The absence or delay of such a notice does not relieve your payment obligations.

6. Liability and Disputes

6.1. Limitation of Liability

  • To the fullest extent permitted by applicable law, neither we nor our affiliates, officers, employees, or agents shall be liable for any indirect, incidental, special, or consequential damages arising out of or related to your purchase or use of any Paid Service, including (but not limited to) currency fluctuations, third-party charges, or service interruptions.

6.2. Governing Law

  • These Payment Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia and the applicable federal laws of Canada, without regard to conflict-of-law principles. Any disputes arising from or related to these Payment Terms shall be submitted to the exclusive jurisdiction of the courts located in Vancouver, British Columbia, Canada, unless consumer protection laws require otherwise.

6.3. Dispute Resolution

  • If you have any dispute or complaint regarding payments, fees, or the Paid Service, please contact us first at support@familymate.ai. We will make reasonable efforts to resolve your issue.

7. Miscellaneous

7.1. Modifications to These Terms

  • We may update or modify these Payment Terms at any time to comply with new legal requirements or to reflect changes in our business practices. Any new terms take effect upon posting, unless stated otherwise. Your continued use or purchase of a Paid Service after the updated terms take effect signifies your acceptance of such changes.

7.2. Entire Agreement

  • These Payment Terms, along with any related policies and agreements (including but not limited to our general Terms of Service, Privacy Policy, etc.), constitute the entire agreement between you and the Company regarding payments for the Paid Service. Any prior agreements or communications are superseded by these Payment Terms.

7.3. No Waiver

  • Any failure or delay by us in exercising a right under these Payment Terms does not constitute a waiver of that or any other right.

7.4. Severability

  • If any provision of these Payment Terms is deemed invalid or unenforceable by a court of competent jurisdiction, such provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.

7.5. Language

  • If these Payment Terms are translated into multiple languages, the English version (if provided) will prevail in the event of a conflict.
